Court dismisses challenge to Dufry duty free contract in Kenya – reports

KENYA. The Kenyan High Court this week dismissed a further challenge to Dufry’s capture of the duty free master concession at Jomo Kenyatta Airport in Nairobi, from long-time local incumbent World Duty Free (no relation to World Duty Free Group). That’s according to reports in The Star newspaper.

As reported, Dufry won the concession last year (after the initial tender was annulled) but then had to overcome several challenges to the award from other bidders.

Separately, World Duty Free of Kenya (owned by local businessman Kamlesh Pattni) took its own case, alleging that it had exclusive rights to operate the shops under an agreement dating back to 1989.

That claim against the Kenya Airports Authority has now been dismissed, with Justice Fred Ochieng quoted as saying that “the application by WDF lacked merit”.
